Man facing attempted murder charges after dispute with neighbor

One man is facing attempted homicide charges in Huntingdon County after a dispute with a neighbor lead to him firing multiple shots Saturday, state police said.

According to a criminal complaint, the Pennsylvania State Police were dispatched to a residence on the 7400 block of Luciana Bottom Road in Clay Township just after 3 p.m. after a 911 call reported that someone had been shot.

State police said that, while troopers were en route, another individual called emergency services from a nearby home and told police that his neighbors had cut a tree down that blocked access to his cabin and that he "shot a clip over their heads".

The criminal complaint states that troopers arrived on scene at both locations and detained John Stout, 62, who made the statement, "He got what he had coming, next time he will do it the right way" in reference to the victim.

According to state police, the victim, who had been shot in the abdomen, was interviewed at UPMC Altoona and said that he had been at a relative's cabin helping to fix his roof when the incident occurred.

The complaint states that the victim told state police that Stout had been causing issues regarding property boundaries and that an attorney had sent a "no trespass" letter approximately three to four weeks prior to the incident, telling Stout that he was no longer allowed on the property and that he had to find an alternative driveway route.

State police said that the victim told them that "no trespassing" signs had been posted throughout the property.

The criminal complaint states that the victim related that, around 3 p.m. that day, he observed a red/silver Chevrolet S10 drive onto the property and that the driver pointed a black gun out of the window and began shooting.

According to state police, the victim began running when the driver began shooting and he was then struck in the abdomen.

State police also said that they spoke with witnesses who were on scene during the incident and determined that there were four people present during the shooting and that bullets were fired in their direction.

The criminal complaint states that witnesses told troopers the location of the truck when the shooting started and that state police observed several bullet holes in the siding of the cabin as well as broken windows.

State police said that another individual on scene had recorded a video during the incident, and that, in the video, the truck is observed and, after four shots, a person shouts they they will return.

According to the criminal complaint, troopers located a pistol on the table in Stout's cabin and a records check concluded that Stout did not have a concealed carry permit.

Online court dockets show that Stout faces four counts of criminal attempted murder, four felony counts of aggravated assault with attempt to cause/causes serious bodily injury with extreme indifference, four felony counts of aggravated assault with attempt to cause/causes bodily injury with a deadly weapon, six felony counts of discharging a firearm into an occupied structure, one count of simple assault, four counts of recklessly endangering another person, one count of defiant trespassing, one count of harassments and one count of firearm not to be carried without a license.

Court dockets show that Stout is currently being held at the Huntingdon County Prison and that his bail was denied due to "no amount of money can assure the safety of the victims or the community from the defendant".

Stout has a preliminary hearing scheduled for Feb. 21.
